The govt can always file additional criminal charges if/when he fails to file again. New day, new charge. Jeopardy doesn’t attach on new charges arising from new conduct.

Do you really think the IRS is going to risk the embarrassment of another trial? The government lost they know they can’t get a conviction against this guy.
