Maybe Murtha should pay for these Marines lawyers. That would be the right thing to do for the trouble he caused, and he should have enough graft to cover it. After all, he was a Marine (S)

I believe the convening authority can reject the Article 32 investigating officer’s recommendation and have it done again. Since I wasn’t a JAG on active duty I’m not sure of that but as deputy to a convening authority I recall something like that. If he has the authority to do so I’d bet it’s rarely used, so a negative Art. 32 report will probably end that case.

That is my understanding from reading posts on other threads from legal officers but as you noted it is rare.

So, will Lt. Col. Ware do the right thing? That is, recommend prosecution of the prosecutors? Conduct unbecoming, bringing false charges, lying, etc., etc., etc.? Aren't officers supposed to not lie? Isn't that one of the things they're supposed to teach them in officer school?

But no. The prosecutors will get promoted, just like liberals only ever "fail up." Screwing up gets rewarded. The morals and values of the legal system are the opposite of those of normal human beings. Never any justice. Just more insanity.
