To: Sue Perkick

I’m thinking back on high profile cases where a lawyer license to practice could have been stripped.

Aside from OJ’s lawyer who’s name excapes me, I can’t think of one who’s lost his license.

Sandy Burgler - get’s his back after basically probation.
Clinton - get’s his back after committing perjury and obstruction
geeesh, I can’t think of a single one

This case really bothers me. I’ve always been on the side of the prosecution, feeling most defense lawyers are nothing more then pond scum. However, I never supported a prosecutor who knowingly went after someone for their own political gain or when they knew, and the evidence bore out, a person was innocent.

Mistakes can happen, evidence is often judged to be something it’s not. However, when we have a system where a prosecutor knowingly continues to ruin a person’s life when the evidence clearly shows innocence, we have a big problem. A bigger problem IMO is when lawyers get away with doing this because their own bar protects them.

One of the problems Fonger has is how many people he’s angered. The governor he made a promise to that he would not run in the next election. The AG who not only declared the boys innocent but referred to Nifong as a “rogue prosecutor”. He’s embarrassed the entire state & I believe they’re going to throw him under the bus. I think it’s just a matter of how many of the wheels are going to get him.

Years ago here in NYS, the lawyers who were involved in the Tawana Brawley mess up in Dutchess County lost their licenses. C. Vernon Mason and Alton Maddox, I think.

Yeah, well I'm not. My uncle is an attorney, used to be a cop. So he's been on both sides of the line, as it were. Just from talking with him, it's abundantly clear to me that the average DA makes the average criminal defense attorney look like an Amish preacher. I would have an attorney at my house for dinner as long as he was polite, but I don't know that I'd even let a DA in my front door. Or on my lawn, for that matter.

The truth is that Nifong has done nothing that DAs everywhere don't do anyway. The difference is that he jumped on some people who had the resources to make him pay. If he had gone after poor white kids, they'd already be in prison with 20 year sentences.

As a result, I find it's a safe policy to generally assume that DAs are lying any time they're talking until they prove otherwise.
