I believe they have the option of presenting this case to a prosecutor and recommending criminal charges to be placed.
Or, perhaps the new DA of Durham, once he’s found guilty at the bar hearing, will take it upon himself/herself (not sure who the new DA is now) to charge Nifong.

Did Nifong know his statements would heighten public condemnation of accused? Did Nifong make misleading statements to media, thus engaging in dishonesty, fraud and deceit?
