He can’t declare until the Law and Order season is finished. If he does, the Equal Time rule would jeopardize the last episodes of the season.

Why hasn't he formed an exploratory committee? I don't believe that triggers the law.

Well, of course, I don’t know for sure, but if he declares sometime in May, like many of us believe, going to the effort of forming an exploratory committee would be a waste of resources. Now, if for some reason he is forced by contracts to wait longer, I would hope that he would form an exploratory committee.

To clarify, if he declares, Law and Order will be forced to run older re-runs which Thompson did not appear in. His producer wants him to run, so I think that will probably work out, as long as the first run episodes are able to show.
