Notice that NBC/MSNBC has copyrighted the video and overlaid its trademarks and video watermarks on both the video and audio tracks made by the killer.

Copyright belongs to the person who produces something, unless they are doing it for hire or otherwise have sold it to someone else. Did NBC pay this guy for the production? Um, no, he was dead when they got it. Has there been a legal transaction to transfer copyright from the original owner (the killer who made the recording) to NBC? Um, no, he was dead about an hour after he mailed it, and there hasn't been time to execute his will if he had one.

So where does NBC get off claiming they own the copyright to something that was produced by someone who was in no way affiliated with NBC?

I imagine that anyone who sends material to a media outlet automatically transfers copyright to said media outlet. At the end of every show that solicits video they say “your material becomes property of us once you send it in.” I’m guessing there is probably a law on the books that codifies that.

they are attempting to do it because he gave it to them. That’s assuming he only sent it to them, and it’s the only existing copy.

he submitted it to them. The fine print usually says news submitted for free to NBC etc becomes their intellectual property.
