Because no one has ever tried to get elected to Congress or the Presidency based on the issue of professional business licensing.I would imagine it would be simpler to campaign on a platform of "I'm going pass legislation to get the ban overturned" rather than "I'm going to work to achieve an unprecedented and unworkable Supreme Court decision to overturn the ban".
