Right, and then we go to a jury and lose anyway. The man was on trial for obstruction of justice. "I don't recall" doesn't work there. I hate Martha Stewart, but I thought she got a raw real too. In such a case, the defendant is basically guilty until proven innocent.

Based on what you said about the jury, I'd say he was guilty when he walked into the courthouse. Based on that, plead NG and say I don't remember specific details. Let the prosecutor prove otherwise on appeal.

I have thought all along that might win on appeal, but it is going to take to long to set up that Bush will pardon him before then anyway. The fact remains that he did not lose here because he had bad counseling, as you suggest. He had the best there is, and he still lost, because it was a foregone conclusion.

She is just afraid of being Scootered. All folk called before that committee should claim the 5th unless granted full immunity.

No one needs to Claim the 5th, they just need to "Plead the Hillary" for crying out loud. I don't remember...I don't remember...I don't recall...I don't remember...don't recall...don't remember...don't recall...

Fred Thompson was on Libby's LEGAL TEAM!! That's the first I've heard that. I know Fred is raising money for Libby's defense, but I didn't know he led the defense! Are you POSITIVE?

The fifth amendment provides: no one "shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

Testimony by oneself in front of Congress can be used against oneself in a criminal trial.

She can plead the fifth all she wants and perhaps Congress can grant her some kind of immunity if it wants her testimony.
