Durham District Attorney Mike Nifong and the lead investigators in the Duke lacrosse case have different recollections of the first time they huddled at the Burlington laboratory that provided DNA testing for the prosecution.
Durham police Sgt. Mark Gottlieb and Investigator Benjamin Himan each listed in their case notes that they were at DNA Security on April 10, a week before any indictments in the case.
And Himan noted that Nifong was present at the meeting with Brian Meehan, head of the private lab.
But in a letter to the N.C. State Bar released this week, Nifong said he could not recall the event, although he acknowledged that a meeting occurred.
"I can only report that I have no recollection of that meeting and that I have no documentation or other evidence that I ever attended such a meeting," Nifong said in the Jan. 16 letter.

Nifong and his ilk have not only ignored the commands of the U.S. Supreme Court, but also the comment to ABA ethical rules such as Rule 4-3.8, which provides: "A prosecutor has the responsibility of a minister of justice and not simply that of an advocate. This responsibility carries with it specific obligations to see that the defendant is accorded procedural justice and that guilt is decided on the basis of sufficient evidence."
It's a damning indictment of both his competence and his integrity, and Nifong richly deserves disbarment. If Nifong's comments here are representative of the type of "defense" he tends to offer at trial on the disciplinary charges, he is (or should be) dead in the water.

Monks leaves party helm

Steve Monks is sorry.
The former chairman of the Durham County Republican Party, who is best known for his unsuccessful write-in candidacy against District Attorney Mike Nifong, had planned to do a lot of explaining in his farewell address to the committee at the county convention Saturday. ......
Regarding his ill-fated run for district attorney, Monks rehashed his decision to make himself a write-in candidate, saying he met with "some powerful Democrats" who told him to pull out of the race, and saying he didn't take "getting pushed around, bribed or threatened by Democrats lightly.
Monks did not name names.**
As a result, he said, "the powerful Democrats who ran this community for so long were ... taught a lesson: Don't take Republicans for granted."
Floyd McKissick, chairman of the Durham County Democratic Party, said he'd never heard of such a conversation and wasn't aware that anything along the lines of what Monks described had occurred. Regarding the district attorney race, McKissick reiterated what he told The Herald-Sun last week, saying the issue of who played what role in Nifong's election was a moot point.

I agree whole heartedly. There is nothing more corrosive to a society built upon the rule of law than to have such misconduct in the prosecution of the law.
With great power must come greater accountability and even greater punishment for those who betray the trust granted with that power.
