Earlier this week, I did a phone interview with Congressman Duncan Hunter, a former Chairman of the Armed Services Committee and a former ranger in Vietnam, who is one of the Republican contenders vying for the presidency in 2008. What follows is an edited transcript of our conversation.

On the O'Reilly Factor last week Giuliani argued for a "practical approach" to immigration and cited his efforts as Mayor of New York City to "regularize" illegal immigrants by providing them with access to city services like public education to "make their lives reasonable."

"Two days ago I announced that the City of New York has filed suit against the federal government. We are challenging a provision of the recently enacted federal Welfare and Immigration Law....Our lawsuit contends that the new federal law violates the Tenth Amendment of the United States Constitution by invalidating New York City's "Executive Order 124."

"For those who may not know, "Executive Order 124" is New York City's policy regarding undocumented immigrants. This order was issued seven years ago by Mayor Ed Koch and then later reissued by Mayor Dinkins and then by me. Giuliani is a pro-choice Republican who is friendlier to gay rights than to gun rights. This is hemlock to most conservatives. He will struggle to attract Republican primary voters without soothing them on these matters.
Giuliani could start by approaching the middle ground on abortion. Rejecting partial-birth abortion (as even Daschle did), promoting parental notification for minors, and advocating adult waiting periods might encourage socio-cons to reconsider Giuliani.

RUDY GIULIANI (R), FORMER MAYOR OF NEW YORK CITY: I'm pro- choice. I'm pro-gay rights.

KING: Giuliani supports a woman's right to an abortion, and back in 1999, he opposed a federal ban on late-term abortions.

GIULIANI: No, I have not supported that, and I don't see my position on that changing.

KING: Immigration could be another presidential landmine. Back in 1996, Mayor Giuliani went to federal court to challenge new federal laws requiring the city to inform the federal government about illegal immigrants.

JEFFREY: He took the side of illegal immigrants in New York City against the Republican Congress.

KING: Giuliani opposes same-sex marriage but as mayor, he supported civil unions and extending health and other benefits to gay couples. He also supported the assault weapons ban and other gun control measures opposed by the National Rifle Association.

GIULIANI: I'm in favor of gun control. I'm pro-choice.
