That's not really a surprise. The AG Cooper will probably say he needs more time to go over all the "facts" of the case.

.....By the mid-1990s, Nifong was getting assigned to the county's most serious felonies. In the courtroom, he showed not just a command of the law but a certain art about trial lawyering.
In 1995, he prosecuted Walter Goldston, who was accused of killing a convenience store owner. Nifong sought the death penalty.
Brian Aus was one of Goldston's attorneys. He remembers that in closing arguments, Nifong started talking to the jury about the angles of bullets -- the state thought that Goldston fired as he lay on the floor. Nifong said, "I hate to do this in a suit," Aus recalled. Nifong flopped on the floor to describe the shooting.
"It was something," Aus said.
Goldston was convicted and sentenced to life.
"He's always very polished," said Aus, who has known Nifong for 22 years. "He doesn't rely a lot on notes or stuff. He just gets out there, gets to his point and moves on."
In his prosecutions, Nifong opened up his entire file to defense lawyers -- something the law didn't require until 2004. It was a matter of fairness, he said in the 2005 interview, but it also added to the intimidation factor. He would tell a lawyer what he had and what he was going to do, and then in court he would do it.
"I was very good at what I did, but I was kind of cocky," he said.
No wonder the daughter lives in Charlotte and was not there for his swearing in.
And any judge will tell you that perjury in their courtroom is right up there near rape and murder. Judges, if no one else, frown upon perjury.

Actually, I thought they might go forward with the hearing because the AG's office doesn't need that much time to prepare on the line-up issue. Also, the AG's office could drop this hot potato of a case by having the judge throw out the IDs and dismiss the case. There were a lot of pros for going forward with the hearing rather than requesting a continuance.
I'll still stick with my prediction that Crystal will never ever appear at any hearing connected to this case.

Thanks, a delay in the Feb 5 hearing would not be surprising.
With Coman and Winstead in charge I believe I would be more concerned if it proceeded on schedule. Too many conflicts of interest. The place seems incestuous.

The murder victim appears to be Precious' mother's brother. Nifong was the prosecutor.

Glanced through the amended complaint. Looks pretty devastating. It's not nice to make misrepresentations to the tribunal! Man, maybe they won't give him a slap on the wrist.
Maybe if the N & O had divulged Nifong's relationship with the AV's family and printed the entire transcript of their interview with the AV we would not be here.
