"The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people."

Proves my point. The Constitution is a limited guarantee of rights, and "the people" i.e. all free men "retain" their God-given rights, even if not enumerated in the Constitution.
