Alright, I guess with this news the RIAA still should vigilantly go after Poindexter, the 13 yr. old, sitting in the basement DLing off P2P program mp3's since obviously he's such a huge threat to sales! < /sarc>

Agreed. I don't condone stealing music or anything else.
I just regret the demise of the record store. Guess I had too many good times
at my local store.
Having said that, I have not bought a CD at the store for a couple of years. I have bought a great deal from iTunes. I guess the change came with the iPod and getting broadband. I would never to go iTunes while on dial up, it just took too long to even preview stuff. Broadband makes it a breeze. I do miss album art, but that died in '88 with the change over to CDs.

I've wrestled with this for a long while. Legally, I agree, the law says it is stealing, however here's why I think the RIAA is going to get burned. They did not create the work and people know this. It's a different story if the ARTIST wants to sue you, they have every right, although they would be absolute idiots too. If artist like Metallica do not recognize "Electronic Media" for what it is then let them create a product that by-passes the medium and see how far these artist get with their work. BTW, where is Metallica today?

I am not arguing the LEGALITY of this, you are correct. This has to do with whether or not you market your product for a demand and not piss off your mostly poor fan base.

It's NOT stealing, it's copyright infringement. The legal system is more complex than you may think.
