From what I read, they were not trying to stay the execution, but rather, trying to stay the handover. Of course, I think the handover to the Iraqis had already happened when they filed.
But is the U.S military under federal jurisdiction when abroad? Wouldn't an appeal have to be made to a military court? I admit I'm ignorant on this...
