Nifong's investigator interviewed the woman Thursday, and she told the investigator that she couldn't "testify with certainty" that she was raped.
Well, then how can she testify with certainty that she was assaulted, or kidnapped??? BS!!!

"
This is a move to keep out all the contrary rape evidence, DNA, contradictory statements, etc by complainant when case is tried."
As well as to keep himself off the witness stand because of the collusion with Meehan regarding the DNA testing. Meehan's testimony opened the door for the defense to call Nifong for questioning.
He remians one ugly nasty piece of work. Hope that the US Dept of Justice is probing his backside with an arc light.

I think kidnapping is meant that the "victim" is forcibly moved from one spot to another and restrained such that they cannot leave. It can literally be as little as a few seconds and a few feet be considered kidnapping.I may be wrong.

Limbaugh says sexual assault and kidnapping charges remain, the "victim" now says she cannot say she was raped. WTF?

Rush just confirmed this. Nifong is still going to pursue sexual assault charges and kidnap. What a guy!

Kidnapping n. the taking of a person against his/her will (or from the control of a parent or guardian) from one place to another under circumstances in which the person so taken does not have freedom of movement, will, or decision through violence, force, threat or intimidation.

No impeachment of her credibility there, huh?
To: abb
Prosecutors said they couldn't proceed without her testimony, so they decided to dismiss the rape charges in the case. I guess the complete lack of DNA evidence being made public has nothing to do with this.
What an absolute pantload. Nifong needs to be the one on trial, not these kids.

This move also gives cover to all of the people who long ago should have called for this whole thing to be dismissed and Nifong investigated, particularly AG Gonzales.

As someone upthread pointed out, her trying to get back into the house is going to weigh somewhat against that "kidnapping" thing.

Rush is saying that Nifong is STILL keeping sexual assault charges against those boys. We'll keep up the pressure to have Nifong charged with prosecutorial misconduct.

In a cowardly, calculated manner, on Friday, the day before the Christmas holdiay he ends this madness. Well I say its time to move forward in a calculated way and have this man arrested, convicted and ruined. Can we make a citizen arrest against this scumbag?
