Nifong filing to dismiss rape charges. Will keep SA and kidnap charges.
They'd be fools not to.

DURHAM - Durham District Attorney Mike Nifong dismissed part of the rape case against three former Duke University lacrosse players Friday after the accuser told detectives she wasn't certain about a critical detail of the alleged attack.
Nifong dropped the charge of first degree forcible rape against David Evans, 23, of Bethesda, Md., Collin Finnerty, 20, of Garden City, N.Y., and Reade Seligmann, 20, of Essex Fells, N.J.. All maintain their innocence and say the allegations are lies.
The three are still charged with first degree sexual offense and first degree kidnapping.
Nifong dropped the charges at 11:37 a.m. Friday. According to the dismissal form, investigator Linwood Wilson interviewed the accuser on December 21.
"The victim in this case indicated that, while she initially believed that she had been vaginally penetrated by a male sex organ (penis), she cannot at this time testify with certainty that a penis was the body part that penetrated her vagina," Nifong wrote in the filing.
"Since penetration of the vagina by a penis is one of the elements of this offense that the state must prove beyond a reasonable doubt, and since there is no scientific or other evidence independent of the victim's testimony that would corroborate specifically penetration by a penis, the State is unable to meet its burden of proof with respect to this offense."
Can't these families sue for defamation of character or something? They've all been put through he!!, and someone needs to be acoountable for that!
Could be he will dismiss the charges one-at-a-time to prevent the pot-bangers from burning the town.

Damn right. Duke U. was disgusting in their rush to judge these guys, they pressured the coach to resign, and allowed violent protests and threats against these boys. I heard on the news, a nice tidbit; Duke's early registration for next semester is down from last year, by 20%. I hope they go bankrupt.
I wholeheartedly agree, but when it comes down to it, he probably enjoys some sort of immunity. I'm not certain of that, of course.
She was penetrated by a lot of other penises however.... Remember the DNA evidence. This is total BS!

Good idea but probably a logical nightmare to coordinate, given the involved parties are likely sprinkled throughout the country right now, as Christmas is just around the corner.
It's not like they'd be hurting anyway - I'm sure any Ivy League school would be more than happy to have spineless PC weasels like them join their institutions.

Did I read correctly, the victim said she couldn't identify the three men 100%?
If there were 30 people in the house and, Nifong says he will pursue kidnnaping, does this mean all who were in the house can now be charged.
Too much speculation presently, will wait until some news agency gets the full context of the story.
Don't know, but apparently it has something to do with whether the penetration was by the male member or something else.
