12-11-1. Special election to fill congressional vacancy--Time of election of representative. If a vacancy occurs in the office of a senator or representative in the United States Congress it shall be the duty of the Governor within ten days of the occurrence, to issue a proclamation setting the date of and calling for a special election for the purpose of filling such vacancy. If either a primary or general election is to be held within six months, an election to fill a vacancy in the office of representative in the United States Congress shall be held in conjunction with that election, otherwise the election shall be held not less than eighty nor more than ninety days after the vacancy occurs.
From what I have found, there is no provision for appointing a new senator if he is incapacitated. An appointment happens in the case of either death or resignation.

How odd. Nothing in this article mentioned that Johnson cheated his way into office with fake votes counted 24 hours after his election run against Thune.
Now, as for this matter of Johnson remaining in the Senate despite his stroke, the example the press has dredged up has nothing to do with it. If Johnson is not on the floor and cannot vote, he cannot vote. End of discussion.

Maybe not a stroke. Could be caused by an bladder infection. But I would think that a stroke could not be ruled out so quickly. Time and a battery of diagnostic testing in a clinical setting will tell.

I also don't want the Senator to die.My point was only this...Sen Johnson`s life is no more precious than the unborn children he votes against.I was thinking only of the high court.There is ZERO excuse for ANYONE being pro abortion.Not being a Christian, is also no excuse,one does not have to be a Christian to know that abortion is wrong.
