To legislate what people do inside their own home, that isn't criminal, is a gross invasion of privacy.

If what they were doing (i.e. the smoke) stayed inside their home, there would not be a problem.

That their smoke is infiltrating the homes of others creates a violation of the other's right to be free.

You can't claim privacy if your smoke is in my house. Duh.

How do they prove it is in their house. Probably isn't proved, They just said it was. Well, if they smoke outside then it isn't in their house. I know, its in their air. Geez, we all may die at the hands of Muslim extremism. Hey, I'll take the smoke. Beats burning autos to the tune of 300 a night. How did we all live through the last 50 years? Amazing

If somebody drives their automobile past your unit, some of that smoke winds up in your house, duh.
