Lee pleaded guilty in 1989 to second-degree murder for the shooting death of Tuai Li-Chun and the attempted murder of her husband, Johnny Soong.Lee was sentenced to 17 years to life in prison for Li Chun's killing, and life with the possibility of parole for Soong's shooting.
Lee, who was 65 at the time of the crime, had sold his restaurant to Soong in return for Soong's promise to make periodic payments toward the purchase price, but Soong repeatedly failed to make payments, according to the 16-page appellate court ruling.
Some of the renegotiation meetings were heated, including one in which Soong pulled a knife on Lee, who came armed with a gun and ammunition the next time he went to the restaurant to collect a payment, the appellate court panel wrote in its ruling.
Soong responded that he didn't have time to talk to Lee, who pulled out his gun and fired five times before the weapon jammed, according to the ruling.
The Board of Parole Hearings concluded in January 2005 that Lee was eligible for parole, citing his lack of previous criminal record, his excellent behavior in prison, his age of 81 and poor health.
In June 2005, Schwarzenegger reversed the board's decision, calling Lee's acts in committing the crimes "atrocious" and saying his acceptance in 2004 of responsibility for the crimes was too recent to tip the scale in his favor.
