It is, but a Federal law (sponsored as a bill in the House by Foley) makes it a Federal crime to use the internet to solicit sex from a minor, irrespective of local age of consent laws.

Isn't that a new law? Would it be in effect retroactively to the time these emails were made?

D*mn! you're right. There was no such law in 2003. The law was passed this year, and can't be retroactive, as that would violate the Constitutional prohibition on ex post facto laws.
