I don't get this either: did those doing this investigation miss what the person said in the IM about his (under)age, or are different IM's/pages at issue here?

The ONLY IM that exists before 2/23 and the man's 18th birthday, dealt with banter and an offer to have the young man over for a drink... when he came back through DC. The young man says he wouldn't be of legal drinking age until Feb 23. The salacious IM's are from April on.
