LOCKESBURG,Ark.No charges will be filed against a Lockesburg woman who shot her husband in the upper right thigh with a .38-caliber pistol, Prosecuting Attorney Tom Cooper said Thursday.
Natallia Roberson, 43, of Lockesburg, allegedly shot her husband, Roy Roberson, 52, during an argument Sept. 22 at their home in the community of Penny Hill, about six miles south of Lockesburg.
Sevier County Sheriff John Partain said the shooting started as a domestic dispute and became a physical altercation involving the couple and Natallias son.
Partain said the womans son had an mp3 player-recorder in his pocket and recorded the argument. The recording was turned over to the Sheriffs Department as part of the investigation.
Roy Roberson was transported by LifeNet helicopter to CHRISTUS St. Michael Health System in Texarkana for treatment of the gunshot wound. He has been released from the hospital.

He might have been carrying his ipod with recorder attachment and punched record. Wouldn't be that hard to do with two yelling people fully absorbed in their own thing.

You can't make the assumption that it was an iPod either. My MP3 player is an RCA Lyra, which includes a 1 button voice recorder and a radio tuner. They're cheaper than iPods, and can be purchased in just about as many places.
There are a LOT of lower cost MP3 players on the market that include voice recording capability. This kid may have simply had one in his pocket (my teenage daughter can't be separated from her MP3 player nowadays) when he realized that the situation was getting a bit hairy.
Her "packing" during an argument does seem very much out of her favor, unless witnesses say the husband was threatening her and she responded to the threats.
Since there is no prosecution planned, I have to assume something like that is likely.

I happen to like iPods but of course you are right, and many of them would not have even required an attachment to record.

Setup or no, that recording apparently was enough to convince the powers that be not to charge her.
Might have been a replay of other fights, and she or they decided to get it on tape, for a divorce action - and, thinking it over, added the .38 - just in case.
I wonder who pays for the helicopter ride when trash like this play their stupid games?
In this guys case - probably not very long at all....
