Oh, I agree 100%. If there was propositioning going on it was totally inappropriate...but, if 16 is the legal age of consent in DC, and sodomy isn't illegal, was a criminal offense committed (assuming there was ever sex)? It's similar to what keeps coming around on the "naughty teacher" threads around here. If a teacher ends up sleeping with a 16-year-old student, and sex with a 16-year-old is legal in that state, is there grounds for any punishment other than administrative punishment by the teacher's employer?
If Foley really was cruising for male pages (*gag*), at the very least I'd love to see all his benefits and pension yanked if he had one coming to him. But until we know more, I don't think we can say something criminally prosecutable happened.

In Florida, Foley's home state, the age of Consent for minors is 16(heterosexual), 18 for Homosexuals. So yes if this is true, it is a criminal offense.
