From a reply on Redstate
on dkos, I found out that the appeals court with the jurisdiction in Michigan is the 6th.
Glancing through the list of judges I see that 6 out of 9, including chief, of the senior judges are GOP appointed. Also out of the regular judges 7 out of 13 are also GOP appointed. So, this seems to be an increasingly conservative court (a lot of new Bush appointed judges).

"Given the composition of the 6th Circuit and its previous rulings in related areas, it seems more likely to favor national security over civil liberties if that issue is squarely presented,"Without national security, there are NO civil liberties for anyone, just as without law, there can be no order.
I guess 50 years of wearing black robes has prepared her well for a burqa.

Inter arma salient leges, which translates as In times of war, the laws are silent. What's the deal with that? Congress never officially declared war

LOL! No need to apologize, of course. Your brain probably just blocked that image out of your head, to ease healing.

Kirpans. That rings a bell. I don't doubt that there were such cases - how did they turn out? I'm guessing by your earlier comment that they were legitimate religious symbols?
One other thing though, Sikhs are from India - - maybe not appropriate to refer to them as from the "middle east"? Pretty good friends with us in the WoT as I recall as well.

Congress never officially declared war Sure they did :)
Click here, for example, to read a transcript of John Kerry referring to our war on terror.

I guess if the ACLU thinks burning the flag is free speech, then they would think blowing up airplanes and taking down skyscrapers could be considered a form of speech as well.
You know, protesting the foreign policy of the US, and all...

Get this, from:
http://apnews.myway.com/article/20060817/D8JI9A281.html
"The American Civil Liberties Union filed the lawsuit on behalf of journalists, scholars and lawyers who say the program has made it difficult for them to do their jobs. They believe many of their overseas contacts are likely targets of the program, which involves secretly taping conversations between people in the U.S. and people in other countries."
So, are they saying their overseas contacts are terrorists?
To: tobyhill
Sure the Government can win.
You already have conflicting rulings between the FISA courts and now this other court.
It's bound for the Supreme Court eventually.
That's how the system works and that's how the battle will be won.

this on the heels of finding out that the recent plot in Britain was foiled in part due to listening to phone conversations between Pakistan and the UK
9/11 wasn't foild even with intercepted phone calls. I didn't know that the UK has the same Constitution that we have. What's your point?
