http://www.wtap.com/news/headlines/3566067.html The Washington County Prosecutors Office announced Monday afternoon it will not proceed with felony charges against two men arrested last week following the purchase of numerous disposable cell phones.
A preliminary hearing that had been set for Tuesday, August 15, will not take place.
The prosecutor's office says it will proceed, though, with the falsification charge as currently filed against Osama Abulhassan and Ali Houssaiky.
According to the prosecutor's office, The state is currently in possession of sufficient evidence in support of probable cause on the felony charges, however, more information is needed to prove the charges beyond a reasonable doubt.
The next step would be to take the matter directly to a grand jury. However, at this time, the state is not prepared to seek indictments because the matter is still under investigation in multiple state jurisdictions, including Michigan.
The Washington County Sheriffs Office continues to be in contact with federal and other state law enforcement authorities, and information is being shared in furtherance of this investigation.
A decision will be made later regarding whether to take this case to the Washington County Grand Jury.
The Washington County Prosecutor's Office and federal authorities say they do not believe that the defendants pose an imminent threat at this time.
