Lon Horiucchi was protected from prosecution by a federal law that protects federal agents from prosecution when "acting in performance of their duties"..

I'm a federal LEO. That law does not grant you automatic immunity - it only covers you if it's a righteous shoot. If it's not a good shoot, for whatever reason, you are liable for both civil and criminal prosecution.

That would imply that Horiucchi made a "good shoot"..

I would have to disagree..

Good. A federal LEO.

Tell your brothers in the Air Marshall Service that pistol bullets only take down aircraft if directed into the pilots.

Tell your brothers in the ATF that they should be a convenience store, not a federal agency.

Tell your brothers in the IRS that the fifth amendment does apply to tax cases.
