How sure are you that racial or sexual comments wouldn't be considered obstructing arrest or creating a disturbance? Especially when they are reported in the article as being directed towards the cops.

Cops could pile on charges almost at will if they desired.

Even under such circumstances that would not be considered a extraordinary "incident" to the arrest.
