Our 'lawmakers' are convinced that they have the power to prohibit specific actions ~before~ they cause any harm.

Think about the basis for firearms & drug prohibitions for instance; - Legislators make a 'finding' that a type of gun or drug is dangerous, -- shazaam, -- they have the power to prohibit its possession or use..


In effect, we have 'lawmaking' by decree.

That sounds like one would be in favor of letting drunks drive? Please correct me if I am misinterpreting your post.
