I guarantee if Bush had gotten a 'Declaration of War'. The USSOC would have had a much harder time coming up with this ruling.
(Yes it would have been an unusual 'Dec of War' since the only sovereign national power involved at the time was the Taliban government of Afghanistan, they could have put in some words about being in a 'state of war' with nations that aid & abet etc.)
Also never underestimate the power of human stupidity !

The SCOTUS was denied jurisdiction over this issue by the Congress. This is nothing short of a coupe. The liberal 5 have have become our dictators. How dare they make this ruling. How dare we obey it!!!
