Sounds like I agree with Elk.

0.08 is too low, in the absence of evidence of actual impairment.

Open container should be nothing more than probable cause to test for actual impairment.

Roadblocks are used because they can't catch most 0.08 drivers, because such drivers evince no impairment (and are less impaired than sober drivers who are a little sleepy, distracted, inexperienced, or elderly.

0.15+ drivers commit most of the carnage. Wasting enforcement on the 0.08 folks lets more of these criminals escape punishment.
