Injured Vet Sues Michael Moore For $85 Million

(CBS4) MIDDLEBORO A local veteran who lost parts of both of his arms in Iraq, is suing filmmaker Michael Moore. Sgt. Peter Damon says Moore recycled old news footage of Damon, and used it in a way that made him seem anti-war.

The snip-it appears in Moore’s film "Fahrenheit 9/11."

Sgt. Peter Damon, a father of two from Middleboro, strongly supports the war effort in Iraq and never agreed to appear in Moore’s movie. According to the New York Post, he is now suing for $85 million.

Damon was interviewed by NBC in 2003 while being treated at Walter Reed Army Hospital. The interview was about a new painkiller being used on injured soldiers. Damon says he did not express any views on the war itself in that interview.

Michael Moore used a clip from that interview in "Fahrenheit 9/11." It shows Damon lying on a gurney, saying he feels like he’s being "crushed in a vice."

The scene appears in a sequence that talks about how the government is abandoning veterans.

You may recall Peter Damon threw out the first pitch at Fenway Park after returning home to Middleboro. The non-profit group Homes For Our Troops also built a home for the Damon family, specially designed for Peter’s physical needs.

The NY Post says the lawsuit also names NBC, Miramax, and other production companies.

how is it possible for Moore to just grab footages of someone without their permission and put it in his movie and make a profit out of other people's image

Indeed his only way out is to claim that F9 11 was "art" or "fiction" or his "opinion".

I love it when folks like Michael Moore paint themselves into a corner and then have to sit there and watch the paint dry!

If he has a case there will be hundreds of lawyers that will take it for 1/3 plus expenses. He won't have to pay a dime.

Wow. That is incredibly unethical that Moore used his words that way. Incredibly unethical. I knew he was scum but I didn't think he was such cynical, deliberate, ghoulish scum.

Under the guise of a 'documentary' or 'news program' I would speculate - won't hold up in court I expect.

I've had this same thought since the Mary McCarthy/Dana Priest/NYT leaking and prize winning.

Is it possible for an average citizen to sue these people for violation of civil rights? By leaking this information and helping the terrorists gain knowledge of what our defensive strategies are, didn't these parties endanger every, but more specifically, any U.S. citizen? What if someone walked into the ACLU office in NYC and said that they were suffering from the treasonous acts of these people? Would that be enough for the ACLU to file suit to protect the rights of one citizen?

It worked for one atheist.
It worked for one pedophile.
Would it work for one average clerk who works in a cubicle in a skyscraper in NYC?

See why people dislike lawyers so much? 1/3 is rediculous, especially in this situation as it should be done PRO BONO because this fella's service affords that lawyer to practice his craft to begin with.

I guess I knew that. I just felt like I wanted to contribute money to something that will cause that fat, sloppy son of a btch some pain or discomfort, or at least take some or all of his property away.

I was also hoping to find a way to let this guy know I support him 100%.

no more...Disney sold Miramax.

There was a court battle with the slimebag Fienstein (?) brothers who started Miramax and named it after their parents (Mira & Max)...I believe Disney sold the company but was able to let the Fienstein fags keep the name...anyway good for this veteran in sooo many ways...
