The Constitution only gives certain limited rights to its citizens to make them self governing or at least that was the intent of the Founders. I thought it gave certain limited rights to the federal government, and "powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people".
