The State Attorney agreed to this before a judge. If Rush fulfills his side of the bargain I expect the judge will not let the State Attorney back out.
No guarantees in life, but I wouldn't worry much about this. The only reason the State Attorney agreed to this is he knows he doesn't have a case. If he had a case he wouldn't accept this, he would want a trial.
