Not unless he has a locked gate. We've been over the matter many times. Your yard really isn't the same as inside your house. On the other hand you can fence it, and put in a locked gate, and additional legal issues begin to play a part. Absent the fence (and locked gate), and the cops can patrol what they see, and here they say they suspected a burglar lurking about.
Best to see what the officers want first, then wait until they're leaving to pull your gun on them. Better luck next time. BTW, with $50 million on the table, there are plenty of sleezy lawyers waiting to take it from him.
