The IRS hasn't been able to match W-2 and withholding tax returns on a current basis until just very recently.

And eventually the truth bears out. The "illegal" aspect is that some people have been adjudicated--by the bedrock bastion of justice known as the IRS--to be "illegal". Heck, lets do away with the United States Supreme Court. Everyone can choose to amend their IRS return without penalty (or due process). The economic and societal impacts are all-important. Silly rights to life, liberty, and the pursuit of happiness are so passe'. But do not forget to appropriate another $100 billion or so for a bunch of ungrateful ragheads in Afghanistan and Iraq. It is the conservative way....

You must be off your meds. The IRS has absolutely no input into deciding who is "illegal". It can't arrest anyone for that "crime", it can't fine or penalize anyone for that "crime". If anything, the issuance of ITINs gives the "illegals" the appearance of legality, making a mockery of their illegal entry into this country.

You also need to do a little judicial review. The courts, including the Supreme Court, have repeatedly ruled the IRS administrative actions are considered "Due Process".
