Mass. high court says nonresident gays cannot marry in the state.

BOSTON --The court that made Massachusetts the first state to legalize gay marriage ruled Thursday that same-sex couples from other states where gay marriage is prohibited cannot marry here.

By that logic, someone from a dry county in Arkansas who is visiting Boston should not be allowed to buy a drink.

This is good news! You'd have thought they'd have relished the extra income from selling marriage licenses.

Even better news would be if they were about to overturn their silly ruling. What's next? Marry my dog? Or my doorknob?

No, it means that if you can't marry your underage cousin in your home state then you can't marry them in MA if the local laws allow it.

See, marriage is more than just a simple commercial transaction.

I would think marriage required some residency requirements. I don't think buying alcohol does.

No, by that logic someone with a Massachusetts fishing license could not use it to fish in Minnesota.

If fishing were illegal in Minnesota, that person could go to Massachusetts and get an out-of-state license that would be good only in Mass.

This, however, does nothing for states where gay marriage is not explicited banned. Now, the big question: will a Mass. judge decide whether or not NY's constitution bans gay marriage before allowing a NY couple to marry?

And if that judge does decide "yes" (not that a Mass. judge has that authority, but why should that stop one), will NY be forced to accept that -- remember, the NY gay community will latch onto such a decision and try to enforce it here.

This is what it boiled down to:

Attorneys for the state, however, argued that the law is being enforced in an evenhanded way for both heterosexual and same-sex couples. They said Massachusetts risks a backlash if it ignores the laws of other states by allowing same-sex couples to marry here when such unions are prohibited in their own states.

Because the "logic" used by the court to legalize homosexual marriage in Mass. certainly allowed its extension. Obviously if other states have a right to define it as they choose, then so did the Mass. people through their legislature. So it's inconsistent, but I think they've realized that the rest of the country -- rushing to put marriage amendments to their constitution in place -- to not want Massachusetts to do the chossing for them. Even with that, they left the door open in two states. Clearly NY and Rhode Island ban homosexual marriage. These ativist judges were just reading those states' judicial tea leaves and hoping they are political weak enough and judicially activist enough to pull a Massachusetts on their citizens.

Only makes sense to them; they want to keep gay marriage legal here in MA, and that doesn't suddenly give them jurisdiction over other states. The issue would go up to the SCOTUS until it was decided in a predictable fashion.

Unlike most FReepers I have no problem with gays marrying, I guess it appeals to my Libertarian side (a very small side, but still). The reason I have no problem with it is because i think the government should stay out of people's lives as much as possible. Also, it looks like a fad to me, one I predict will fade to the point where a handful are taking advantage of this.

Oddly enough, the most militant anti-gay marriage person I know is openly gay. He thinks it's just silly. I agree with him.

None, you do not have to be a previous or current resident of Massachusetts to obtain a marriage license that is valid statewide.

So, once again, it appears the law in Massachussetts is what their Supreme Court deems it to be, in spite of clear legislation to the contrary.

LOL. You must be kidding. I mean besides the subject I would think this would be for all states both hetro and homo. I mean at least one person in a state should be a resident. I don't think this is too out of line. Nevada is a completely different place due to the entertainment factor. Those marriages are shames anyway. They don't last so I don't consider that in the same caliber as other marriages.
