Woman Sues For Wrongful Birth of Surviving Twin After Failed Abortion

PERTH, United Kingdom, March 21, 2006 (LifeSiteNews.com) - A young woman who gave birth to a daughter, after a failed abortion left one of her twins still alive, is suing for damages against the hospital that carried out the procedure.

Stacy Dow, 21 years old, discovered she was pregnant with twins when she was 16, reported the BBC yesterday. She decided to abort her babies. Following the abortion she was given a contraceptive injection and told to expect weight gain and irregular menstruation as side effects.

When she went to her doctor months later, she found one child had survived the abortion. Ms. Dow was only seven weeks away from giving birth. At that late stage of pregnancy she could not have another abortion. Late-term abortions are illegal in the UK unless the mother's life is in danger.

Ms. Dow is suing the Tayside University Hospitals NHS Trust for £250,000. She wants to cover the "financial burden" of raising her five-year-old daughter, Jayde.

She also wants compensation for being forced into the difficulties of being a single mother, for the emotional and psychological distress she suffered after discovering she was still pregnant, and for the "pain and discomfort" of having her daughter by Caesarean section.

The hospital wants the claim thrown out. Hospital officials say Ms. Dow's daughter is "normal and healthy", and £250,000 is an excessive claim. They also say no contract between the hospital and Ms. Dow was entered into, and she was never guaranteed a successful abortion.

I'm certainly glad the child survived, but I'm also glad this hospital is getting sued.

The hospital did not properly perform the abortion. If they are going to look at abortion as just another medical procedure, then they should expect to get sued when they botch one up, just like they would with any other medical procedure.

She had and gave birth to a LIVE HUMAN BABY who is now 5 years old. Why can't she be happy for her healthy daughter. FORGET THE MONEY.

They should take her daughter away from her, this monster has no business being a parent.

BINGO! That would solve the mothers problem of having to raise her as well as the daughters problem of growing up with a mother that has already tried to kill her.

You have to be careful not to equate an undesirable result with a "botched" procedure. If you develop cancer, for example, and you receive the normal treatment given in a proper manner, and you still die, then there really is no basis for a lawsuit.

I think there should be a rule. If you try to kill your kid and fail, give the child up for adoption. PLEASE!!!

No one should be taken care of by someone who tried to have them killed.

I spoke with a coworker who had an abortion so I know this is correct...When you go for an abortion first you must watch films describing the procedure and you must sign papers acknowledging the abortion fails 25% of the time so you must be ready to accept the fact that you might very well still be pregnant after the abortion...there are no guarantees!!

I fear for the physical safety of this innocent child in addition to her mental health. She should be removed from this parent's custody immediately. No doubt her mother has let her know in uncertain terms that she was unwanted--I cannot begin to imagine the heartache she must have knowing her mother was disappointed that she lived.

We have lost a whole generation of babies thru abortion. Have none of these women ever heard of birth control?

Is this ironic or what...I am watching a 6 month-old baby tonight. He is precious and gorgeous. His mom told me when she brought him over that she was pregnant again and went for abortion, She fears that the abortion "failed" She still shows positive on a pregnancy test and the abortion center wants her back there ASAP. She said, " If the child survived it is seriously deformed and I've got to get it out of me"!!!! makes me ill.

What a horrific situation! More irony. Friends at church adopted a baby in state; the teenage mother changed her mind when he was a few months old and they were heartbroken. They finally succeeded in adopting a baby out-of-state--she is now 2--and are hoping to adopt a brother or sister for her. They would give anything to be able to conceive a child. Why is it so easy for those who have no intent and can so easily discard a "mistake"?

Kin of ours delivered twins at 23 weeks--2lb 3oz girl, 2 lb 10 oz boy. That's when I learned girls can survive at a lesser weight. I visited them in the hospital at 25 weeks; it was like being in the presence of God. Those little hearts were beating--it really was a miracle. Both survived and are doing well.
