I am a lawyers, and of course it matters - you (negligently or on purpose) are not quoting the last part of the statute: ". . . fraudulently inducing the belief that he or she is a peace officer . . ."
And you are neglicting to put in the key phrase:
...who willfully wears, exhibits, or uses the authorized uniform, insignia, emblem, device, label...
