Marvin Eugene Barnes told police he never meant to harm his girlfriend's 19-month-old son. He also said he never threw the boy against a bedroom wall two days before Christmas in December 2004, fracturing the boy's skull and sending him into a coma.

Kerri Thomas, Bishop's mother, told the court nothing was wrong with her son when the family woke up that morning. He was playing with the other children, babbling and tossing a ball. He also ate his lunch, Thomas said, when she and Barnes took the children to Taco Bell around 2:30 p.m.
"The defendant took me to work, dropping me off about 3:15 p.m., and I noticed Bishop was ready for a nap," she said. "The next time I saw Bishop was on Christmas Day. They wouldn't let me see him the first two days he was in the hospital because it was being investigated as child abuse.
"Then we had to decide on Dec. 29 if we should leave him on life support or take him off and let him die," she said, crying.
An autopsy performed the next day showed the toddler had irreversible brain damage.
