Specter needs to stand his ground here.
Specter: Leahy and I have not disagreed on very much. I went back to the transcript and found Feingold's vigorous cross examination of AG's confirmation and know he raised issues of torture and searches without warrants.
And I've reviewed the provisions of US (some section code) and of US Code where Oliver North testified and there are provisions there and it's my judgment it's unnecessary to swear the AG in.
Leahy: If the witness doesn't object, why don't we ask AG. I know only you can swear in, but I'd give it myself -- why not just do it.
Specter: The answer why I won't do it is I've examined the facts and the law. But I'll ask the AG if he objects or minds being sworn in. The reason I won't swear him in isn't up to him. It's up to me and I'm the Chairman.
Leahy: He's been here 3 times and was sworn in before.
Specter: The CHair has ruled. And if there's a vote, I hav a pretty good idea, how it will come out.
Voting: Not to swear in passes.
Feingold asks for roll call vote which they are doing now.
