What Graham means is that there is no way Congress would give this authority to HILLARY CLINTON!

Well there goes Lindsey shooting himself in the foot again

Lindsay likes to show off how "nuanced" his thinking is. Too bad he's wrong about that. Somehow he drags the discussion around to his pet issue of torture.

Graham: Hypothetical. Detainee in our charge. Info available that can save thousands of lives. President gives authority to find info from detainee. Pre-existing statute re Uniform Code of Justice that tells troops that they can't do certain things to prisoners.

What do we do?

Gonzales: The president has already said we aren't going to engage in torture. As to whether or not the statute you referred to would be constitutional, these questions are difficult. One statute gives Congress specific authority regarding captures. There is disagreement among scholars.

Graham: Congress has authority to regular military and the military code of justice is a statutory scheme giving guidance to the military that Congress passees.

We can tell our military "don't you do this to a detainee" and you as a CIC can say "we gotta win the war and protect ourselves" and I'm worried about the person in the middle here.

MEMO TO GRAHAM: That person in the middle would be YOU. At best.

Whatever we think of Gonzalez I'm amazed at where he came from and where he is now. He's so bright and came from such an impovrished background, he is living proof you can become something while having nothing.

An important incident to the conduct of war is the adoption of measures by the military commander, not only to repel and defeat the enemy, but to seize and subject to disciplinary measures those enemies who, in their attempt to thwart or impede our military effort, have violated the law of war. Ex parte Quirin, supra, 317 U.S. 28, 63 S.Ct. 11.

That sanction is without qualification as to the exercise of this authority so long as a state of war exists-from its declaration until peace is proclaimed. See United States v. Anderson, 9 Wall. 56, 70; The Protector, 12 Wall. 700, 702; McElrath v. United States, 102 U.S. 426, 438; Kahn v. Anderson, 255 U.S. 1, 9, 10 S., 41 S. Ct. 224, 226.

I think that we need to push for legislation to require that all candidates for congress pass an intelligence test before they can run for office. (sarc) Some of these folks are not real bright.

Besides all that, Gonzales is the one who MADE the Clintons to return all that stuff they stole from the White House?
