Landreu won't be voting for the judge, I hadn't heard that. I did hear Kent Conrad won't be voting for a filibuster either.

Remember though Diane Feinstein said she wouldn't filibuster last week and she has changed her position.

Don't be surprised if the Democrats are playing rope a dope and saying some members won't vote for a filibuster but end up doing so.

What is Lieberman's position on filibuster?

Tell everyone you know to FREEP Senators Conrad, Dorgan, Landreu, Lieberman, Byrd, Johnson, Salazar, and Nelson from Nebraska. Call Chafee, Snowe, Voinovich, and Hagel too, never know when they get a wild hair.

As it stands now, even with Feinstein, cloture will succeed and the filibuster will be defeated.

Going nuclear to go nuclear would ensure the option is defeated as well, I can guarantee that.

I would expect even some liberal dems would vote as needed to ensure cloture given that the Dems really do not want to force the Republicans to go nuclear. With someone like Harriet Miers the Democrats had enough solid objections that had it not been withdrawn her nomination could be considered an "extreme circumstance". But I don't see that as being true of Alito.

As long as the Democrats don't push the Republicans to use the nuclear option, they'll retain the filibuster-threat card which may still be useful against some nominees. But if they use the filibuster and it gets nuked, they'll lose that power. So it would be better for the Democrats to get clotured than nuked.

BTW, one rule change I'd like to see regardless would be a requirement that senators who are going to filibuster actually do so. Historically, there have been many filibusters defeated without a successful cloture vote because the other Senators were able to wait out the one doing the filibuster until he got exhausted and gave up.

That is not what Feinstein said. Last week she said she did not think a filibuster would succeed. That is not the same thing as saying she would not vote for cloture.

It is the same as if She had said before the 2004 election that she thought Bush was going to win. That would not mean that she was going to vote for Bush.. It just meant the she did not think Kerry was going to win.

DiFi is doing this to get Hugo Chavez's puta off her back. What would be absolutely hilarious is if Frist instructed all of the Republicans to also vote "no" on cloture and then say he has no choice but to nuke that joint. Make the 'RATS pay a price for their insanity. That would do it.

In addition to the Senators previously mentioned, Landrieu, Pryor, and Conrad have all indicated they would oppose the filibuster. With their votes, we wouldn't need to depend on Salazar. Still, the margin will be fairly close - it wouldn't surprise me if 37 or so Democrats end up voting against cloture. So, it wouldn't hurt to call your Democratic senator(s) if they are on the fence on this issue. Posters on the DailyKos and other wacko liberal sites are still urging their followers to call Senators, and their efforts seem to be having some effect.
