Frist also said that there would be a vote come hell or high water on January 20th. There will be a vote if and when Democrats decide there should be a vote.
He did it under the cloture rule which limits debate and forces the vote as I understand it.
Will kerry filibuster before he votes for Alito, or will he vote for Alito before he filibusters? He hasn't decided on his strategy yet.
It's ironic that the WSJ mentions respect for the free exercise clause when it was Scalia's decision in Smith that largely eviscerated it.
Other than that I thought it was fairly on point.

A filibuster would be the final nail in the Dim's coffin. I hope Kerry goes for it. Alito is superbly qualified, certainly not an extraordinary circumstance. If half the gang of 14 renege on their promise and go along with a filibuster the 7 Republicans will be incensed. They will lead the charge to nuke the judical filibuster. At that point, the Dims will have nothing left - not even the empty threats of morons like Kerry.
