So kennedy just now says that he learned in high school that there were two branches of government "house and senate" and that they pass a law and the president signs it. I think it's safe to say that we now know why Kennedy flunked in school

Yeah....and I have heard Biden say, on two occasions, that the Supreme Court MAKES laws.
