I'm a bit puzzled by this. It looks to me like the Rusher papers are available at the Library of Congress for anyone to research. Why is this subpoena necessary? Just a stall and delaying tactic, and a way for the dems to claim that the pubbies are hiding something?

Regarding delay and stall tactics by Kennedy:
Specter should say to Kennedy something to the effect of "Just let me get this straight, for the record, for the benefit of your supporters: you are planning to vote for Judge Alito, but you might find something in Rusher's papers that would change your mind?"
