I thought that Alito was being thoughtful, which is what judges should do. And BTW, the poor man is probably exhausted

That he didn't come up with Quirin, Milligan and other cases surprized me - but he did come back later with other cases on the general subject. I have no concern about his performance in this arena, BTW. He dealt well with the more narrow topic of surveillance earlier in the day. Graham was focused on the detention aspect of war powers.
