Graham wants to advance the proposition that, if he and McCain get their legislation, the President's hands are tied.

Sort of. I'll have to read the transcript because Graham is going pretty fast - but sometimes he is arguing for Presidential power, other times for Congressional power. Lost in that is how to balance rights of enemy (zero) with rights of civilians - who will say how much civilian right will be impinged? Will there be oversight?

Graham has valid concerns, FWIW, but this is a crappy way to air them.

One has to do that with Lindsey. I so often wonder where the heck he is going with his questions, but in the end it usually makes sense. I look forward to seeing your analysis of the transcript.
