Alito - I don't think looking to foreign law is helpful to discern OUR form of government.
Our Constitution is more protective of human rights than foreign law is.
Other times looking to foreign law is legitimate, e.g., interpretation of an international treaty - provate cases where the rule of decision (by contract) is based on foreign law.

Confirm him already!

Yes. My state Senator(Kyl). He's pointing out how Justice Breyer and others use the standards of several other nations(he names them) to make their rulings. Do those justices need a refresher course in how to uphold our constitution, or what?

the reality of the case in question was whether or not U.S. Marshalls acted reasonably when carrying out the order to "SEARCH ALL PERSONS PRESENT" when executing the warrant.

O'Connor says "not an undue burden if it only inhibits a few"

There goes Kohl's argument, "What if a provision only impacts ONE person?" Well, Senator Kohl, see O'Connor and her rhetoric on that point. I've read the case, BTW, and ALito explians himself "why" very well. Therefore, I conclude that Kohl either did NOT read the case, or he did and thought he could score a point with his assinine question.

THE FAMILY LEAVE ACT IS ONE THE MOST IMPORTANT PIECE OF SOCIAL LEGISLATION IN HISTORY?? (Sorry for yelling.) That just about sums up the sheer vapidity of the Dimocrats. That was/is the WORST piece of lazy ass, anti-employer, anti-constitutional, anti-capitalist piece of legislation ever written.

Dang. I like this. Out of the 38 so called "Roe used as precedent" cases, only a few really are useful as upholding Roe.

I've found similar when digging into the cites used by appellate courts to justify their arguments - more often that one might think, the court misrepresents the gravamen of the case they are citing.

That list of 38 cases must have been kicking around for awhile because there is no way a rebuttal to the list could be prepared in a matter of 8 or 10 hours.

This Senator is actually talking about the fact that Roe wanted the decision reversed. I think this actually occurred a couple or so years ago, but I think the ACLU said it just doesn't matter-we want our way!

Perfect. He's got Feinstein trapped in her own little web. A court ruling(Stare Decisis) is not, the be all, and end all. Go back to the constitution, if in doubt.

Sessions needs to shut up. He's trying to be a constitutionalist cheerleader for Alito but in doing so, he is opening up can after can of worms.
