Delay will not be acquited if the trial stays in Austin, the Big Blue Anus of Texas. There is no way he can get a fair trial in the lefty/gay capital of Texas. Shame on this Democrat judge for throwing the case this way.

From my understanding of this thread, here is what stands:
  1. Conspiracy charges -- dismissed.
  2. Change of venue -- not granted.
  3. Money laundering charges -- not dismissed. Judge will now investigate other motions on this charge, including prosecutorial misconduct.

A mixed bag on the surface, but I think the dismissal of a charge -- any charge -- indicates that the judge is not happy with the prosecutor.

It's my understanding that getting a dismissal of charges is VERY difficult, so I think it is a small victory for Delay and a huge defeat for Earle. Priest took one of Earle's indictments and said "nope" before any hearings started. There was no change of venue, so that might not be good, but if Priest is intending the full smackdown of Earle, including prosecutorial misconduct, we are on that road now.

It seems to me that he looked at the charges and found them ridiculous, but there must be something to the money laundering charges that needs to be explored.

However, I think that the "something" has to do with Ronnie Earle, IMHO.

In fact the money laundering charge is the weakest one and hence it is no big problem. Also Delay was not the speaker of the House but the majoirty leader. You need to get your facts right.

Hmmm...

DeGuerin had asked to have the indictments dismissed because of prosecutorial misconduct. Priest said he would hear that motion only if he upheld the indictments against the legal challenges.

I think the Judge was simply afraid of the consequences if he threw out all the charges at once.

After all, he does want to eat lunch in that town again.

If the facts are with Delay, he cannot get any worse than a hung jury, even in Austin there will be at least one juror who won't go along with a whitewash.

This case isn't really about money laundering.
It's about redistricting. The dems in Texas and the Clinton holdovers in the Justice Dept. are still foaming at the mouth about that.
