Does he have any relationship with the child? Has he, Mason, treated the child like his child -- nights at his house, going to the zoo, things like that? Does the child think Mason is his father, because of his, Masons, actions?

If the answer to these questions is no, then he should try to appeal to the State Supreme Court. If, on the other hand the answer is yes, Mason may want to see if his relationship with the child is important enough to continue "being" his/her father.

Why spend a small fortune on a lawyer for a long-odds shot at a reversal? It might be a better idea for him to petition his state legislators to change this obviously unjust law.

Knowing myself, I'd have a hard time walking away from the child after 1 year regardless if it's mine or not.

On the other hand, I'd be rather worried that the "real" daddy would show up in a few years to claim what is his.

You know, at one point, I wondered if my child from my then-wife was actually "mine." I thought long and hard about it. Then I decided that it didn't make a difference. I love my daughter more than life, and even if she wasn't biologically mine, she's still my daughter and I'm still her Daddy.
